Personal Information We Collect or Process

When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

  • Contact details including your name, address, billing address, shipping address, phone number, and email address.
  • Payment information (e.g., tokenized payment identifiers and limited card details) processed via our payment providers. We do not receive or store full payment card numbers or security codes; such data is processed directly by PCI DSS Level 1–certified providers (e.g., Shopify Payments). We retain transaction metadata (e.g., amount, time, method) for accounting, fraud prevention, and compliance.
  • Account information including your username, password, security questions, preferences and settings.
  • Transaction information including the items you view, put in your cart, add to your wishlist, or purchase, return, exchange or cancel and your past transactions.
  • Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry.
  • Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
  • Usage information including information regarding your interaction with the Services, including how and when you interact with or navigate the Services.

Personal Information Sources

We may collect personal information from the following sources:

  • Automatically through the Services including from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies;
  • From our service providers including when we engage them to enable certain technology and when they collect or process your personal information on our behalf;
  • From our partners or other third parties.

How We Use Your Personal Information

We process your personal information only where we have a lawful basis under applicable data-protection laws. Depending on how you interact with the Services, we rely on the following bases and purposes:

  • Provide, tailor, and improve the Services (contract; legitimate interests). We process your information to perform our contract with you (for example, processing payments, fulfilling orders, arranging shipping, managing your account) and to pursue our legitimate interests in operating, improving, and personalizing the Services (such as remembering your preferences and recommending products)

  • Marketing and advertising (consent where required; legitimate interests). Where required by law (including for the use of cookies or similar technologies in the EEA/UK), we obtain your consent before sending marketing communications or delivering targeted/interest-based advertising. In other cases, we rely on our legitimate interests to market our products and services. You may withdraw your consent at any time and opt out of marketing as described in the Your Rights and Choices section (e.g., unsubscribe links in emails, replying STOP to SMS, or updating cookie preferences)

  • Security and fraud prevention (legitimate interests; legal obligations). We process information to authenticate accounts, provide a secure shopping and payment experience, detect and prevent fraud, abuse, or illegal activity, and comply with our legal obligations

  • Communications and support (contract; legitimate interests). We communicate with you about your orders and account and respond to inquiries as necessary to perform our contract and to pursue our legitimate interests in providing customer support

  • Legal and compliance (legal obligations; legitimate interests). We process information to comply with applicable laws and respond to lawful requests, and to establish, exercise, or defend legal claims

  • Vital interests (vital interests). In rare cases, we may process information to protect you or others from serious harm

US state privacy laws. Where US state laws apply (e.g., California, Colorado, Connecticut, Utah, Virginia), we may process personal information for “targeted advertising” (also called “cross-context behavioral advertising”) and may “sell” or “share” identifiers as those terms are defined by law. You can opt out at any time via Your Privacy Choices (Do Not Sell or Share My Personal Information) and through our cookie preferences tool

Legitimate interests balancing. When we rely on legitimate interests, we consider and balance those interests against your rights and freedoms and implement safeguards appropriate to the processing

Where personal information is transferred outside your country of residence, including to countries that may not offer an equivalent level of data protection, we implement appropriate transfer mechanisms such as standard contractual clauses or other recognised safeguards

Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Children's Data

The Services are not directed to or intended for use by children. We do not knowingly collect personal information from anyone under 13 years of age in the United States or under 16 years of age in the European Economic Area, United Kingdom or Switzerland. SMS Marketing

Program description. When you provide your mobile number and opt in, you agree to receive recurring text messages from MyArt about promotions, updates, and (if enabled) cart reminders. Message frequency varies. Message and data rates may apply. Messages may be sent using an automatic telephone dialing system or similar technology. Your consent is not a condition of purchase.

Sharing and transfers. We share your SMS data with service providers that process messages on our behalf (e.g., SMS platforms and mobile carriers) solely to provide the messaging service. We do not sell your mobile number, and we do not share your SMS opt-in or consent status with third parties for purposes unrelated to providing the service. Your information may be transferred to and processed in countries where our providers operate (including the United States). We take appropriate safeguards for such transfers.

Retention. We retain your mobile number and consent/opt-out records for as long as you subscribe to SMS or as needed to comply with law, resolve disputes, and enforce our agreements. If you opt out, we may retain limited records (e.g., opt-out status and timestamp) to honor your choice and for compliance.
